Ex-president John Dramani Mahama wants ongoing petition put on hold

Lawyers for former President John Dramani Mahama have filed an application for stay proceedings at the Supreme Court in the election petition hearing.

A seven-Member panel of the apex court chaired by Chief Justice Kwasi Anin Yeboah on Wednesday issued some timelines for the parties to follow including the Petitioner filing their witness statements by 12noon today.

The Stay of Application was filed today, Thursday, January 21, 2021.

The Court will hear the matter on Tuesday, January 26, 2021.

The former president on Wednesday filed a motion for a review of the ruling of the court.

However, the Petitioner of the 2020 presidential election at the Supreme Court has instead filed a stay.

Mr. Mahama argues that the court erred when it ruled that CI 47 was not applicable.

They also argue that the court should have exercised its discretionary powers in accordance with article 296 of the constitution.

This provision requires an authority vested with discretionary power to be fair and candid. They further state that the court got it wrong yet again when it took the view that the current rules requiring expeditious trial mean even amendments are not allowed.
