It would be recalled that the Parliamentary candidate for the National Democratic Congress “NDC” after the outcome of the 2020 December polls, Prof. Dr. Grace Ayensu-Danquah Petitioned the Sekondi High Court arguing that there irregularities concerning the Essikado-Ketan parliamentary elections making Mr. Joe Ghartey’s win a dubious one.
However the Sekondi High Court in the western region presided over his Lordship, Dr. Richmond Osei Huere has punched counsel for first Respondent “Hon. Joe Ghartey”, Lawyer K. Amoah who was represented lawyer Frank Davies who was absent in court with a fine of Four Thousand Ghana Cedis “GH¢4,000.00”.
The above court fine against the former Railway Sector Minister who doubles as the Essikado-Ketan MP camp is allegedly said to be as a result of the defendant’s counsel wasting the precious time of the court.
The Sekondi High Court Judge, after legal references and interpretations on Tuesday March 23, ruled that the application by first respondent to strike out the petition, was untenable.
In his ruling, the judge told the court that “lawyers act as client’s agents litigation in which case, they can sign on behalf of their clients”.
The gravamen of the matter was that, last week, defendant’s lead lawyer, Frank Davis was of the view that the court should not even hear the substantive matter because the petition was signed by the petitioner’s lawyer but Lawyer David Ametekpe, was also of the view that the law does not state emphatically that the parliamentary candidate should be the one only to sign the petition.
“A great shock was sent down the spine of Hon. Joe Ghartey MP for Essikado-Ketan as the Sekondi High Court dismissed the frivolous preliminary objection brought to it by him”.
Furthermore the Sekondi High Court on its sitting today March 23rd 2020, ruled in favour of Prof. Dr. Grace Ayensu Danquah as she wins the frivolous preliminary objection by the legislature, Hon. Joe Ghartey.
Meanwhile the surgeon, Prof. Dr. Grace Ayensu Danquah, on the other hand, was very much happy together with her supporters. She sees victory at the end of this case because according to her, the 2020 Essikado-Ketan parliamentary election was stolen by Hon. Joe Ghartey.
It is said Hon. Joe Ghartey’s paraded ten member legal team led by Lawyer Frank Davis as against Lawyer David Ametekpe, the only lawyer for the petitioner “Prof. Dr. Grace Ayensu-Danquah”.
A delegation from the National Democratic Congress “NDC” in the western region including Kofi Totobi Quakye, Nana Kojo Toku, Hon. Daniel Eshun, Mrs. Charlotte Otuwa Odum among other big wigs of the partywere present at the Sekondi High Court.
The date for the hearing of the substantive matter is said to be determined by the Sekondi High Court.
